1. About Highlife Cannabis
Highlife Cannabis operates authorized retail cannabis stores across Ontario under licences and authorizations granted by the Alcohol and Gaming Commission of Ontario (AGCO). All of our retail locations hold valid Cannabis Retail Store Authorizations (CRSAs) and comply with the Cannabis Licence Act, 2018, the Cannabis Control Act, 2017, Ontario Regulation 468/18, and all applicable federal and provincial legislation governing the sale of recreational cannabis in Ontario.
All cannabis products sold at Highlife Cannabis locations are sourced exclusively through the Ontario Cannabis Store (OCS), the province's sole authorized wholesale distributor.
2. Age Requirement
You must be 19 years of age or older to access this Website, purchase cannabis products, enter any Highlife Cannabis retail store, or use our delivery and curbside pick-up services. By using this Website or making a purchase, you confirm that you meet this age requirement.
Valid government-issued photo identification may be requested at any time, including upon entry to our stores, at the point of sale, upon delivery, and during curbside pick-up. If you appear to be under 25 years of age, identification will be required before any transaction can be completed.
3. Use of This Website
This Website is provided for informational purposes, to help you locate our stores, browse available products, and access click-and-collect or delivery services where available. You agree to use this Website only for lawful purposes and in compliance with all applicable laws and regulations.
You may not:
- Use this Website in any way that violates any applicable federal, provincial, or local law or regulation
- Attempt to gain unauthorized access to any part of this Website, its servers, or any connected systems
- Use any automated system, software, or script to access, scrape, or collect content from this Website
- Misrepresent your age or identity
4. Products and Pricing
All cannabis products sold by Highlife Cannabis are legal, regulated products sourced through the Ontario Cannabis Store (OCS). Product availability, selection, and pricing may vary by location and are subject to change without notice.
We make reasonable efforts to ensure that product descriptions, images, and pricing displayed on our Website are accurate. However, errors may occasionally occur. In the event of a pricing error, we reserve the right to cancel or refuse any order placed at an incorrect price.
All prices are listed in Canadian dollars (CAD) and include applicable taxes unless otherwise stated. Cannabis products are subject to federal excise duty and provincial taxes as required by law.
5. Online Orders, Click-and-Collect, and Delivery
Where available, Highlife Cannabis offers click-and-collect and delivery services in accordance with AGCO regulations. All online orders must be placed with a specific store location and are fulfilled from that store's on-site inventory.
For delivery orders: delivery is available only to private residences or private places within Ontario. Deliveries may only be completed between 9:00 a.m. and 11:00 p.m. A valid government-issued photo ID must be presented upon delivery, and the recipient must be at least 19 years of age. Third-party delivery services are not permitted under Ontario regulations; all deliveries are completed by Highlife Cannabis employees.
For click-and-collect orders: payment must be completed online or by phone prior to pick-up. A valid government-issued photo ID must be presented at the time of collection, and the individual picking up the order must be the same person who placed and paid for the order.
6. Purchase Limits
In accordance with federal law, the maximum amount of cannabis an individual may possess in public is 30 grams of dried cannabis, or its equivalent in other product formats, per the Cannabis Act (Canada). Highlife Cannabis will not complete a transaction that would cause a customer to exceed this limit.
7. Returns and Refunds
Due to the nature of cannabis products and the strict regulations governing their sale under the Cannabis Act (Canada) and Ontario Cannabis Retail Regulations, all sales of cannabis products are final. Please refer to our separate Refund and Return Policy for complete details on exceptions and the process for reporting product defects or issues.
8. Intellectual Property
All content on this Website, including text, graphics, logos, images, and software, is the property of Highlife Cannabis or its content suppliers and is protected by Canadian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Website without our prior written consent.
9. Privacy
Your use of this Website is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using this Website, you consent to the collection and use of your information as described in our Privacy Policy.
10. Disclaimer of Warranties
This Website and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Highlife Cannabis does not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not provide medical advice. Cannabis products should be used responsibly and in accordance with all applicable laws. If you have questions about cannabis use and your health, please consult a healthcare professional.
11. Limitation of Liability
To the fullest extent permitted by law, Highlife Cannabis, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Website or any products purchased through our stores or online services. Our total liability for any claim arising from or related to these Terms shall not exceed the amount paid by you for the product or service giving rise to the claim.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of this Website shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario.
13. Changes to These Terms
We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to this Website.
